TCM 2026 SWEEPSTAKES OFFICIAL RULES

NO PURCHASE, PAYMENT, OR MARKETING CONSENT IS NECESSARY TO ENTER OR WIN. A PURCHASE, PAYMENT, OR MARKETING CONSENT WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

1. No purchase, payment, or consent necessary

1.1 No purchase or payment of any kind is necessary to enter or to win this sweepstakes (the promotion). Providing marketing consent is optional and is not required to enter or to win, and choosing not to provide marketing consent will not affect your chances of winning. A purchase, payment, or marketing consent will not increase your chances of winning.

2. Sponsor and Administrator

2.1 The sponsor of the promotion is TCM Bank, N.A., 3501 E. Frontage Rd., Suite 200, Tampa, FL 33607 (Sponsor). The promotion is administered by the Sponsor. The entities that may send you marketing communications if you provide the optional consent described in Section 6 are TCM Bank, N.A. and the financial institution identified in that consent as the issuer of your card.

3. Eligibility

3.1 The promotion is open only to legal residents of the fifty United States and the District of Columbia who, at the time of entry and at the time of the drawing, (i) are the named primary cardholder on an open and active TCM personal or business credit card account that is in good standing, and (ii) are at least eighteen years of age or the age of majority in their state of residence, whichever is older. For a business credit card account, the named primary cardholder is the individual whose name is embossed on the card or, if no individual name is embossed, the individual designated in Sponsor's account records as the primary authorized officer or account administrator for that account.

3.2 The following persons are not eligible: employees, officers, and directors of Sponsor, the Administrator, and their respective parent companies, affiliates, and agencies, and the immediate family members (spouse, parent, child, sibling, and their spouses) and household members of each such person.

3.3 Cardholders who are already enrolled to receive SMS text messages from Sponsor as of the start of the Promotion Period are also eligible.

3.4 The promotion is void in any jurisdiction where it is prohibited or restricted by law.

3.5 A person who enters on the basis of a business card account enters in an individual capacity, represents that they are authorized to enter and to provide any consent given on the entry form, and is the sole person eligible to be a winner with respect to that entry. Any prize will be awarded to that individual.

4. Promotion Period

4.1 The promotion begins on September 1, 2026 at 12:01 AM Eastern Time and ends on October 31, 2026 at 11:59 PM Eastern Time (the Promotion Period). Except as provided in Section 5.3 for mail-in entries, entries must be received during the Promotion Period to be eligible. Sponsor's computer or designated timekeeping records are the official time for the promotion.

5. How to enter

5.1 There are two ways to enter, and each method has an equal chance of winning. Limit one entry per cardholder during the Promotion Period, regardless of method. Duplicate entries will be disqualified, and only the first eligible entry received from a cardholder will be retained.

5.2 Method one, online. During the Promotion Period, complete and submit the official online entry form at https://info.tcmbank.com/sweeps, which requires your first name, last name, the last four digits of your TCM card account number, your email address, your mobile telephone number, and your state of residence. Your entry will be recorded upon submission of these required fields whether or not you choose to provide the optional marketing consent described in Section 6. The required fields are used to confirm eligibility and to notify you if you win.

5.3 Method two, mail. Hand print on a plain piece of paper your first name, last name, the last four digits of your TCM card account number, your mobile telephone number, your complete mailing address, your email address if you have one, and the statement that you wish to enter the TCM 2026 Sweepstakes, and mail it in a hand-addressed envelope with sufficient postage to TCM 2026 Sweepstakes Entry, 3501 E. Frontage Rd., Suite 200, Tampa, FL 33607. Mail-in entries must be postmarked during the Promotion Period and received by November 13, 2026. No marketing consent is requested or required for a mail-in entry. Mechanically reproduced entries are not permitted.

5.4 All entries become the property of Sponsor and will not be returned. Sponsor is not responsible for late, lost, misdirected, incomplete, illegible, or undeliverable entries, or for any error in the collection or processing of entries.

6. Optional marketing consent

6.1 The online entry form includes a separate, optional check box by which you may agree to receive marketing communications as described in the consent language. The box is not pre-checked. Checking the box is optional. You are not required to provide this consent in order to enter or to win, and your chances of winning are the same whether or not you provide it. The text of the consent appears in Appendix A to these Official Rules and includes instructions for opting out at any time. If you provide consent, you may withdraw it at any time as described in the consent and in Section 13.

7. Winner selection and odds

7.1 Six (6) potential winners will be selected in a random drawing from among all eligible entries received during the Promotion Period. The first eligible entry drawn will win the grand prize, and the next five eligible entries drawn will each win a first prize. The drawing will be conducted on or about November 16, 2026 by the Administrator, whose decisions are final and binding on all matters relating to the promotion.

7.2 The odds of winning depend on the total number of eligible entries received.

8. Winner notification and verification

8.1 Each potential winner will be notified by telephone call, text message, or email at the contact information provided with the entry, on or about November 18, 2026. A potential winner must respond within five (5) business days of the first notification attempt. If a potential winner cannot be contacted within that period, does not respond, is found to be ineligible, or fails to comply with these Official Rules, the prize may be forfeited and, time permitting, an alternate winner may be selected from among the remaining eligible entries.

8.2 A potential winner may be required to complete, sign, and return, within five (5) business days of delivery, an affidavit or declaration of eligibility, a liability release, and, except where prohibited by law, a publicity release, and, for any prize with a value of two thousand dollars or more, a completed Internal Revenue Service Form W-9. Failure to return required documents within the stated period may result in forfeiture.

8.3 Sponsor will confirm that the information submitted with a potential winner's entry matches the corresponding TCM cardholder record before awarding any prize.

9. Prizes

9.1 Six (6) prizes are available: one (1) grand prize and five (5) first prizes. The grand prize is a cash prize in the amount of five thousand dollars ($5,000). Each first prize is a cash prize in the amount of one thousand dollars ($1,000). The total approximate value of all prizes is ten thousand dollars ($10,000). No more than six (6) prizes will be awarded, and no individual may win more than one prize.

9.2 Prizes are non-transferable, and no substitution is permitted except by Sponsor.

9.3 All federal, state, and local taxes on a prize are the sole responsibility of the winner. For any prize with a value of two thousand dollars or more awarded during calendar year 2026, the winner must provide a completed Form W-9, and Sponsor or the Administrator will issue an Internal Revenue Service Form 1099-MISC reporting the value of the prize. Sponsor reserves the right to apply backup withholding as required by law where a winner fails to furnish a correct taxpayer identification number.

9.4 Prizes will be paid by check or electronic funds transfer within thirty (30) days after the winner completes verification under Section 8, and in any event during calendar year 2026.

10. General conditions; modification; disqualification

10.1 By entering, each entrant agrees to these Official Rules and to the decisions of Sponsor and the Administrator, which are final and binding.

10.2 Sponsor reserves the right, in its sole discretion, to disqualify any individual it reasonably believes has tampered with the entry process or the operation of the promotion, has acted in violation of these Official Rules, or has acted in an unsportsmanlike or disruptive manner.

10.3 If the promotion is not capable of running as planned for any reason beyond Sponsor's reasonable control, Sponsor reserves the right, subject to any applicable state approval and to the limitation described in Section 10.4, to modify, suspend, or cancel the promotion, or to select winners from eligible entries received before the action was taken.

10.4 The limitation referenced in Section 10.3 is as follows: where prizes have been announced and a drawing is required, Sponsor will award the prizes in the manner and at the time stated in these Official Rules, consistent with applicable state law.

11. Release and limitation of liability

11.1 By entering, each entrant releases Sponsor, the Administrator, and their respective parent companies, affiliates, subsidiaries, agents, vendors, and the officers, directors, and employees of each (the Released Parties) from any liability for any claim, injury, loss, or damage arising out of participation in the promotion or the acceptance, use, or misuse of any prize, to the maximum extent permitted by law.

11.2 The Released Parties are not responsible for any technical, hardware, software, telephone, network, or electronic malfunction, for any incorrect or inaccurate information, or for any error in the administration of the promotion, including in the processing of entries or the announcement of winners.

12. Disputes and governing law

12.1 These Official Rules are governed by the laws of Florida, without regard to conflict-of-law principles, and the exclusive venue for any dispute not subject to Section 12.2 is the state and federal courts located in Tampa, Florida.

12.2 Arbitration and class action waiver. Except for a claim that qualifies for small claims court, any dispute or claim arising out of or relating to the promotion or these Official Rules that cannot be resolved informally shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted before a single arbitrator in the county of the entrant's residence, at another mutually agreed location, or by remote means, and Sponsor will pay all filing, administration, and arbitrator fees to the extent required by those rules. ALL DISPUTES WILL BE ARBITRATED ON AN INDIVIDUAL BASIS ONLY. NEITHER PARTY MAY BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION, AND THE ARBITRATOR MAY NOT CONSOLIDATE THE CLAIMS OF MORE THAN ONE PERSON. This Section 12.2 is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq. If the class action waiver in this Section is held unenforceable as to a particular claim, that claim, and only that claim, shall proceed in the courts identified in Section 12.1, and this Section shall otherwise remain in full force. This Section 12.2 does not apply to entrants in jurisdictions where its mandatory application to these claims is prohibited by law.

13. Privacy and communications

13.1 Information collected from entrants is used to administer the promotion, including to confirm eligibility and to notify winners, and is handled in accordance with Sponsor's privacy policy at https://www.tcmbank.com/cardholder-services. The mobile telephone number and other information you provide with your entry will not be used to send you marketing calls or texts unless you separately provide the optional marketing consent described in Section 6.

13.2 If you provide the optional marketing consent, you may withdraw it at any time by any reasonable means, including by replying STOP to any text message, by calling the telephone number on the back of your card, or by using the contact information in Sponsor's privacy policy. Sponsor will honor a withdrawal as soon as practicable and in any event within ten (10) business days.

14. Publicity

14.1 Except where prohibited by law, acceptance of a prize constitutes permission for Sponsor to use the winner's name, city, and state for promotional purposes without further compensation.

15. Force majeure

15.1 Sponsor is not liable for any failure or delay in performance under the promotion caused by events beyond its reasonable control, including acts of God, natural disaster, labor dispute, governmental action, failure of telecommunications or data networks, or pandemic.

16. Winners list

16.1 For the name of each winner, available after December 15, 2026, send a self-addressed stamped envelope to TCM 2026 Sweepstakes Winners List, 3501 E. Frontage Rd., Suite 200, Tampa, FL 33607, or visit info.tcmbank.com/2026winners. Sponsor will also file winner information with state authorities as required by law, including a winners list with the Florida Department of Agriculture and Consumer Services and a Certification of Winners with the New York Department of State.

17. Severability

17.1 If any provision of these Official Rules is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Registration

18.1 This promotion is registered and bonded in Florida and New York as required by law.

A.2 Required form footer

A.3 Implementation requirements

A.3.1 The consent box is unchecked by default and is visually and functionally separate from the required entry fields.

A.3.2 Submission of the form records the entry whether or not the consent box is checked. This behavior is confirmed by functional test before launch, not by design review alone.

A.3.3 TCM Bank is populated with the cardholder's specific issuing bank, by personalized campaign link or by account lookup, before the box can be checked. Generic references to agent banks are not used.

A.3.4 When the consent box is checked, consent is signed and effective at submission, and the system sends one enrollment-confirmation text containing the program disclosures and the STOP and HELP instructions. No marketing message is sent to a number until the confirmation text has been sent, and none is sent the same day. If the confirmation text cannot be delivered, marketing to that number is suspended until the number is confirmed. For consents captured by telephone through the IVR or the contact center, the confirmation text requests a YES reply and marketing begins only after the YES reply is received. STOP and HELP are honored immediately in all cases. Links in the confirmation text and in any program text use a Bank-branded domain, not a public link shortener.

A.3.5 The system retains, for at least six years: the exact consent text displayed, the checked or unchecked state, the date and time of submission, the IP address and user agent for web submissions, the mobile number, the state of residence, the account association, the source of the visit, and the transmission and reply logs for the confirmation text.

A.3.6 This Appendix A is the controlling text. Marketing materials, landing pages, and vendor builds that touch entry, consent, prizes, or eligibility must match these Official Rules and this Appendix verbatim.
